The current law
Under the Gambling Act 2003, it is illegal for a company based in New Zealand to offer online casino gambling to Kiwis. However, the Act does not make it an offence for an individual New Zealander to play at a casino based overseas. That's why every real-money casino serving Kiwis is hosted offshore (Curaçao, Malta and similar jurisdictions).
This is set to change: the Online Casino Gambling Act 2026 introduces a licensed regime from December 2026.
